BATON ROUGE - East Baton Rouge District Attorney Hillar Moore said Tuesday that the deputy who killed a man in November 2016 will not face a grand jury.

Moore released recordings of law enforcement response to what investigators say was the murder of April Peck, 30, by her boyfriend, Terrell Walker, 48.

Walker is believed to have shot his girlfriend and pushed her out of a car at United Plaza Boulevard and Essen Lane.

Walker fled the scene but later returned. Walker opened fire on a crowd of people and paramedics trying to help the mortally-wounded Peck, Moore said. 

Daniel Wesley, who was a 17-year-old EMT in training, was shot twice and run over by a vehicle. He survived.

Deputies spent hours looking for Walker. When they found him, Moore said, he shot at deputies and was shot repeatedly in response.

Walker died at a hospital from his injuries. Moore said Walker's autopsy reveled he was shot five times.

Walker's blood-alcohol level 0.028 grams percent and he had traces of methamphetamine, hydrocodone,  PCP and marijuana in his system at the time of his death.

Moore said that after reviewing the evidence, he decided that the case did not merit presentation to a grand jury that could have considered criminal charges against the deputy.
