BATON ROUGE - Sheriff's deputies booked a man into jail late Friday night hours after his wife died from a gun shot wound to the head.

Louisa Garcia, 27, died at a hospital. Deputies responded to reports of her being shot around 11 a.m. Friday in the 8300 block of Amy Drive in the Gardere area.

Juan Angel Delarca Martinez, 27, was charged with murder and illegal use of a weapon.  The sheriff's office announced his arrest around 11 p.m. Friday.

Initially, deputies were told the shooting was an accident.  Investigators wrote in arrest documents, Martinez told them he and Garcia were fighting when she pulled out a gun and it discharged while he was trying to get it from her.  Evidence did not support the story, investigators said, so Martinez was arrested.

An unidentified witness told authorities, the pair were fighting in their bedroom when a gunshot was heard.  The witness said they had to disable the lock to the couple's bedroom door and found Garcia shot and Martinez standing over her.

Neighbors said there was a child in the apartment at the time of the shooting.
