18-year-old arrested after sexually assaulting victim in abandoned car
BATON ROUGE - An 18-year-old Baton Rouge man was arrested after he reportedly sexually assaulted a female victim in an abandoned car.
According to arrest records, the victim told authorities that she was an acquaintance of the accused, Joseph Hayes. The victim said she went to Hayes' house to visit him when Hayes asked her to go sit in an abandoned car at a house under construction down the street so he could smoke.
While in the back seat of the car, the victim said Hayes began kissing her on her neck and told her she needed a man that could take care of her. She told Hayes that she did not like boys and that Hayes knew she was a lesbian.
Hayes then took the victim's pants off and sexually assaulted her, according to arrest records. The victim said she tried to stop him but she "froze up."
After the victim was sexually assaulted, she put her clothes on and walked home, according to arrest records.
The victim then went to Woman's Hosptial, where a rape kit was performed by a Sexual Assault Nurse Examiner.
During this time, detectives contacted Hayes and interviewed him. He told authorities that he did have sex with the victim but it was consensual. At the time, Hayes was released pending further investigation.

Authorities were later contacted by the SANE supervisor at the hospital, who said the evidence collected suggests the incident was not consensual.
Hayes was arrested and booked into the East Baton Rouge Parish Prison on one count of third-degree rape.
